What factors should someone consider before accepting a settlement or going to trial?

Anytime a client is offered a settlement, we sit down with the client and we say “okay well, here’s your range of fairness. Here, if they offer between these numbers, then you should consider settling your case.” But, if the insurance company offers less than this amount that we recommend, based on our experience [we suggest they try the case].
Then it’s always up the client to decide what they want to do. Do they want to take less than what we recommend? It’s always their decision.
If they decide no [on the settlement], then we go into litigation. Then we go the trial route. And while there are always no guarantees, we always tell people that, based on our track record, this is what we can expect out of a particular case.
