Settling a case is not a lawyer’s decision. It never is, and it never should be. Settling a case is the client’s decision.
So, at our firm, when a settlement offer is made that the lawyers believe to be fair and reasonable, we sit down with our client. We present everything that we know about the case, both the good things and the bad things about the case. We tell them about our other trials of similar cases and what results they’ve yielded and what results we’re looking at for them today in a settlement. Ultimately, it’s a client’s decision, and what we do is counsel them on that decision and try to show them why, based on these numbers and our experience, we believe this to be fair.
